Shareholder Ed Rice has authored the legal reference book Pennsylvania Secured Transactions Under Revised Article 9 of the UCC, Forms and Practice Manual, which was published this winter by Data Trace Publishing Company. The book covers a comprehensive review of the law in Pennsylvania for secured transactions under revised Article 9 of the UCC. Attorney Sharon M. Menchyk is a contributing author of the book.

Mr. Rice's practice focuses extensively on information security and related technical matters for sophisticated clients, including financial institutions and application service providers. Mr. Rice is a frequent lecturer on topics such as privacy and security and consumer financial services issues. Mr. Rice is a member of the bar of New York and Pennsylvania.

Erin E. Milliken was named a 2007 Pennsylvania Rising Star by Philadelphia Magazine. The complete list of Pennsylvania Rising Stars will be included in a special December issue of Philadelphia Magazine, published by Law & Politics. The award recognizes just 2.5 percent of Pennsylvania attorneys.
Ms. Milliken is an associate at the firm, practicing in the Insurance Coverage Services Group. She represents primary and excess insurance carriers in various complex insurance coverage matters involving professional lines of insurance including, fiduciary liability, directors and officers liability and professional errors and omissions liability.

The Third Circuit Court of Appeals Bar Association was founded during this past summer by attorneys from all districts which form the Third Circuit. Shareholder James R. Hankle was a founding member of the Association.
The Association was formed to improve the quality of appellate practice and facilitate relationships between the Court and those practicing before the Third Circuit. Mr. Hankle is a member of the firm’s Litigation Services Group and has practiced before the Third Circuit on various appellate matters since 1982.

Director Christine M. Long, a board member of the St. Thomas More Society, participated in presenting the 49th Annual Red Mass sponsored by the Society. The Red Mass was held on October 23, 2007 at St. Mary of Mercy Church.
Bishop David Zubick, the newly ordained bishop for the Catholic Diocese of Pittsburgh, presided at the Red Mass which honored Judge Kate Ford Elliot the first woman president judge of the Superior Court of Pennsylvania. Ms. Long is a member of the Estates and Trusts Services Group and practices in the areas of tax and domestic relations as well.
Ms. Long, a member of the Allegheny County Bar Association’s Family Law Section Council Guidelines Subcommittee has recently been named Chair of that Section’s Mentoring Subcommittee.
Ms. Long spoke, by invitation of the Western Pennsylvania Chapter of the Pennsylvania Society of Public Accountants, on the tax aspects of separation and divorce and specific ethical problems associated with representing either or both of the parties in a divorce under new regulations issued relative to Practice before the Internal Revenue Service (Circular 230).

Shareholder Samuel J. Pasquarelli successfully argued a case of first impression in the Commonwealth Court of Pennsylvania, in which, the Commonwealth Court was asked to determine whether, under the Pennsylvania Workman’s Compensation Act, a spouse who was receiving workers’ compensation benefits as a result of the death of her husband in a work related accident would have her benefits reduced when she began to receive social security benefits at the age of 65.
The Commonwealth Court held that the Act did not provide for such a reduction and the spouse could continue to receive both the full workers’ compensation benefits as well as her social security benefits. Frank Bryan, Inc. v. Worker’s Compensation Appeal Board, 921 A.2d 546 (Pa. Cmwlth. 2007).
Mr. Pasquarelli has also recently been named one of two trustees of the Kathryn Dinardo Fund, a charitable fund that supports charitable endeavors as selected by the trustees. The fund provides funding in the amount of $200,000 annually for various charitable organizations.

Shareholder Gary Philip Nelson, having been named one of "The Best Lawyers in America" (Woodward/White), was selected by his peers as a Pennsylvania Super Lawyer for 2007 (Law & Politics).
In earning his Pennsylvania Super Lawyer recognition, Mr. Nelson was one of the top 50 recipients for votes cast for Pittsburgh lawyers. Mr. Nelson is a Shareholder and Director of the firm and a member of the firm's Financial Services Group.

Shareholder John P. Edgar, a member of the firm’s Litigation Services Group, successfully represented Geneva College against the efforts of a trustee to revise the terms of a charitable trust to provide new grants to charities on whose boards he or his wife sat at the expense of four charities named by the donors.
Mr. Edgar was first to identify the improper shift and file an Objection in the Orphan’s Court of Allegheny County. The Court ruled that the trustee could not reallocate the funds as he sought to do, but instead, must comply with the trust as it was written. Mr. Edgar’s successful legal work allowed the local college as well as the three other beneficiaries to receive funds from the trust in the manner the trust provided.
This past summer John Edgar was again elected a Trustee of the Synod of the Reformed Presbyterian Church of North America. This is his eighth three-year term over the past 30 years. Mr. Edgar also serves as a Trustee of Geneva College.

SouthwestUSA Bank Turnaround
SouthwestUSA Bank, a Nevada Financial institution, recently announced its release from the restrictions of a cease and desist order by the FDIC and State Department of Business and Industry. SouthwestUSA Bank was placed under a cease and desist order in November, 2006.
The institution retained long-term firm client and friend, Patrick Wisman of PB Solutions as Chairman and CEO of the financial institution to assist in its turnaround. Mr. Wisman, with his over 35 years of bank turnaround experience, and the Bank’s senior management team, are credited for implementing one of the quickest turnarounds of a financial institution in recent banking history. In less than ten (10) months, bank management addressed and complied with the terms of the cease and desist order such that on October 16, 2007, the institution was formally released from the order.

Prior to joining the firm, Ms. Block served as a judicial clerk to the Honorable Jeffery A. Deller of the United States Bankruptcy Court for the Western District of Pennsylvania and also practiced commercial litigation as an associate at a large international law firm. Ms. Block received her law degree from the University of Pittsburgh School of Law in 2004 and her B.A., with distinction, in Philosophy and Hebrew from the University of Michigan.
Prior to joining the firm, Mr. Davis was an associate at a mid-sized litigation firm in Pittsburgh. Mr. German was honored for his significant contributions to advancing juvenile diabetes research. Mr. German is the former Chairman of the Board of the JDRF International and has been active in the local and national JDRF for over 15 years.
JDRF is the leading charitable funding organization and advocate of type 1 (juvenile) diabetes research worldwide. The mission of JDRF is to find a cure for diabetes and its complications through the support of research. Type 1diabetes is a disease which strikes children suddenly and requires multiple injections of insulin daily or a continuous infusion of insulin through a pump. Insulin, however, is not a cure for diabetes, nor does it prevent its eventual and devastating complications which may include kidney failure, blindness, heart disease, stroke, and amputation.
Since its founding in 1970 by parents of children with type 1 diabetes, JDRF has awarded more than $1 billion to diabetes research, including more than $123 million in FY2006. In FY2006, the Foundation funded 500 centers, grants and fellowships in 20 countries.
